Voted down 4-0 by Board of Supervisors on March 11, 2025.
On February 24, 2026, the Board of Supervisors voted 3-2 to amend the county Surveillance Use Policy so the sheriff’s office cannot operate, manage, or use data from Flock cameras, a change that covers the contract cities of Cupertino and Saratoga and the town of Los Altos Hills. Supervisor Betty Duong said the county should not do business with Flock; Supervisor Susan Ellenberg voted no because she opposes license plate readers from any vendor. The policy requires reporting to the board if county-controlled reader data reaches the federal government, with compliance audits every 4 months. On March 11, 2025 the Board of Supervisors approved a no-cost memorandum of understanding with the City of Cupertino covering use of automated license plate readers from March 11, 2025 through June 30, 2026, and the item names the Flock Safety Falcon system. The county bought nothing. The item states the readers will be purchased, installed and maintained by the City of Cupertino and that there are no fiscal implications to the county general fund, which is why no county amount or camera count is given.
